Conducted by NFHA, Dane Law LLC, and the Christensen Law Firm (the \u201cNFHA Consortium\u201d), the \u201c<strong><a href=\"https:\/\/default.salsalabs.org\/T9278ceb9-e7d1-4911-bf5f-9a24e1c56b58\/6f4a59eb-532a-492d-9163-9a863ff497c3\" target=\"_blank\" rel=\"noreferrer noopener\">Appraisal Standards and Appraiser Criteria Report<\/a><\/strong>\u201d (\u201cReport\u201d) is the most comprehensive review of the governance, structure, training, and industry standards to date. It presents a roadmap for Congress, regulators, advocates, lenders, and the appraisal industry to address the nation\u2019s long legacy of bias in the valuation of real estate and build a future in which a family\u2019s most valuable asset is treated fairly.\u202f&nbsp;<\/p>\n\n\n\n<p class=\"content-wrap-item post__paragraph\">Based on the research and recommendations in the Report, we provide answers below to several of the questions raised during the briefing. We also want to acknowledge that the Report is a starting point for conversation among stakeholders seeking workable, sustainable solutions that benefit the whole of the housing market. There are many other areas for additional discussion and research. Several of the questions posed during the briefing note these areas for follow up, which we list below. At this point, The Appraisal Foundation has not provided a response to the NFHA Consortium directly or the general public, but has provided information to a reporter from <\/span><i><span style=\"font-weight: 400;\">HousingWire <\/span><\/i><span style=\"font-weight: 400;\">and to a public meeting of The Appraisal Foundation Advisory Council. NFHA provided a response to these comments, which can be found <\/span><a href=\"https:\/\/www.asc.gov\/Documents\/GeneralCorrespondence\/2022.02.04%20-%20NFHA%20Letter%20to%20TAF%20-%20USPAP%20and%20AQB%20Criteria%20Review.pdf\"><span style=\"font-weight: 400;\">here<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In addition, the U.S. Department of Justice, Department of Housing and Urban Development, Federal Housing Financial Agency, Consumer Financial Protection Bureau, and the other federal financial regulators submitted a<\/span><a href=\"https:\/\/files.consumerfinance.gov\/f\/documents\/cfpb_appraisal-discrimination_federal-interagency_comment_letter_2022-02.pdf\"> <span style=\"font-weight: 400;\">joint comment letter<\/span><\/a><span style=\"font-weight: 400;\"> to The Appraisal Foundation\u2019s Appraisal Standards Board asking for a \u201cfull presentation\u201d of the fair lending laws in the appraisal standards. The Consumer Financial Protection Bureau also wrote an accompanying<\/span><a href=\"https:\/\/www.consumerfinance.gov\/about-us\/blog\/appraisal-discrimination-illegal-under-federal-law\/\"> <span style=\"font-weight: 400;\">blog post<\/span><\/a><span style=\"font-weight: 400;\"> strongly emphasizing that \u201cappraisal discrimination is illegal under federal law\u201d and raising concerns that The Appraisal Foundation has failed to include clear warnings about the requirements of federal law.<\/span><\/p>\n                                    <\/div>\n                                <\/div>\n                            <\/div>\n                                                    <div class=\"accordion-item\">\n                                <h2 class=\"heading-3\" id=\"accordionHeading1\">\n                                    <button type=\"button\" class=\"accordion-btn collapsed\" data-target=\"#FAQ1\" data-toggle=\"collapse\" aria-controls=\"FAQ1\" aria-expanded=\"true\">\n                                        Discretion seems to be a significant issue. Was FIRREA stipulating that there be a party with discretion involved?                                    <\/button>\n                                <\/h2>\n                                <div class=\"collapse \" data-parent=\"#accordionFAQ\" id=\"FAQ1\" aria-labelledby=\"accordionHeading1\">\n                                    <div class=\"card-body\">\n                                        <p><span style=\"font-weight: 400;\">A: <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Financial Institutions Reform, Recovery, and Enforcement Act of 1989, as amended (\u201cFIRREA\u201d) only provides the following with respect to setting the appraisal standards:<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">Each Federal financial institutions regulatory agency and the Resolution Trust Corporation shall prescribe appropriate standards for the performance of real estate appraisals in connection with federally related transactions under the jurisdiction of each such agency or instrumentality. These rules shall require, at a minimum\u2014<\/span><\/i><\/p>\n<p><i><span style=\"font-weight: 400;\">(1 ) that real estate appraisals be performed in accordance with generally accepted appraisal standards as evidenced by the appraisal standards promulgated by the Appraisal Standards Board of the Appraisal Foundation;<\/span><\/i><\/p>\n<p><i><span style=\"font-weight: 400;\">(2 ) that such appraisals shall be written appraisals; and<\/span><\/i><\/p>\n<p><i><span style=\"font-weight: 400;\">(3) that such appraisals shall be subject to appropriate review for compliance with the Uniform Standards of Professional Appraisal Practice.<\/span><\/i><\/p>\n<p><i><span style=\"font-weight: 400;\">Each such agency or instrumentality may require compliance with additional standards if it makes a determination in writing that such additional standards are required in order to properly carry out its statutory responsibilities.<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">12 U.S.C. \u00a7 3339. Thus, there is nothing in FIRREA that prevents The Appraisal Foundation from addressing the issue of discretion in the context of potential discrimination.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Appraisal discrimination is clearly prohibited under the federal Fair Housing Act and Equal Credit Opportunity Act and the federal financial regulators have long stated that discretion is one of the key risk factors that can lead to a violation of the Fair Housing Act or the Equal Credit Opportunity Act. <\/span><i><span style=\"font-weight: 400;\">See, e.g., <\/span><\/i><span style=\"font-weight: 400;\">the <\/span><a href=\"https:\/\/www.ffiec.gov\/pdf\/fairlend.pdf\"><span style=\"font-weight: 400;\">Interagency Fair Lending Examination Procedures<\/span><\/a><span style=\"font-weight: 400;\"> (2009). For these reasons, the Report recommends: \u201cConsistent with other aspects of the housing finance market, the appraisal process should be thoroughly reviewed for fair housing risk, particularly in the exercise of discretion, and the [appraisal standards] should be amended accordingly in order to provide a baseline standard for fair and equitable outcomes.\u201d <\/span><i><span style=\"font-weight: 400;\">See<\/span><\/i><span style=\"font-weight: 400;\"> Report at pages 52-56.<\/span><\/p>\n                                    <\/div>\n                                <\/div>\n                            <\/div>\n                                                    <div class=\"accordion-item\">\n                                <h2 class=\"heading-3\" id=\"accordionHeading1\">\n                                    <button type=\"button\" class=\"accordion-btn collapsed\" data-target=\"#FAQ2\" data-toggle=\"collapse\" aria-controls=\"FAQ2\" aria-expanded=\"true\">\n                                        What is the racial\/gender breakdown of The Appraisal Foundation boards?                                    <\/button>\n                                <\/h2>\n                                <div class=\"collapse \" data-parent=\"#accordionFAQ\" id=\"FAQ2\" aria-labelledby=\"accordionHeading1\">\n                                    <div class=\"card-body\">\n                                        <p><span style=\"font-weight: 400;\">A: <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Appraisal Foundation does not provide a breakdown of the race and gender of its board members, or whether they are active appraisers. The main point is that the broad discretion in the appraisal process increases the risk of unfair undervaluations and overvaluations, both of which tend to disproportionately impact consumers of color. All stakeholders in the housing market would benefit from a fairer, more transparent, repeatable appraisal process that is grounded in data science.<\/span><\/p>\n                                    <\/div>\n                                <\/div>\n                            <\/div>\n                                                    <div class=\"accordion-item\">\n                                <h2 class=\"heading-3\" id=\"accordionHeading1\">\n                                    <button type=\"button\" class=\"accordion-btn collapsed\" data-target=\"#FAQ4\" data-toggle=\"collapse\" aria-controls=\"FAQ4\" aria-expanded=\"true\">\n                                        Were any appraisers of color interviewed for this Report?                                    <\/button>\n                                <\/h2>\n                                <div class=\"collapse \" data-parent=\"#accordionFAQ\" id=\"FAQ4\" aria-labelledby=\"accordionHeading1\">\n                                    <div class=\"card-body\">\n                                        <p><span style=\"font-weight: 400;\">A: <\/span><\/p>\n<p>Yes, the NFHA Consortium interviewed appraisers of color, but they asked not to be identified.
