{"id":11497,"date":"2025-09-11T17:00:11","date_gmt":"2025-09-11T21:00:11","guid":{"rendered":"https:\/\/nationalfairhousing.org\/?p=11497"},"modified":"2025-09-11T17:00:12","modified_gmt":"2025-09-11T21:00:12","slug":"advocates-strongly-urge-trump-administration-to-uphold-rule-that-advances-justice-and-fairness-for-all","status":"publish","type":"post","link":"https:\/\/nationalfairhousing.org\/advocates-strongly-urge-trump-administration-to-uphold-rule-that-advances-justice-and-fairness-for-all\/","title":{"rendered":"Advocates Strongly Urge Trump Administration to Uphold Rule that Advances Justice and Fairness for All"},"content":{"rendered":"\n<p class=\"content-wrap-item post__paragraph\">FOR IMMEDIATE RELEASE: <\/p>\n\n\n\n<p class=\"content-wrap-item post__paragraph has-text-align-center\"><strong>Advocates Strongly Urge Trump Administration to Uphold Rule that Advances Justice and Fairness for All<\/strong><\/p>\n\n\n\n<p class=\"content-wrap-item post__paragraph\">WASHINGTON, D.C. \u2014 A coalition of over 90 leading civil rights, consumer, and housing advocates from across the nation has issued a<a href=\"https:\/\/nationalfairhousing.org\/wp-content\/uploads\/2025\/09\/2025-09-09_NFHA-et-al-Letter-to-OMB-HUD-re-Disparate-Impact.pdf\"> joint letter<\/a> strongly urging the Office of Management and Budget (OMB) and the U.S. Department of Housing and Urban Development (HUD) to withdraw a pending Final Rule, which is likely to roll back the disparate impact standard under the federal Fair Housing Act. This letter comes after HUD has <a href=\"https:\/\/www.reginfo.gov\/public\/do\/eoDetails?rrid=1049512\">sent<\/a> a \u201cFinal Rule\u201d entitled \u201cHUD\u2019s Implementation of the Fair Housing Act\u2019s Disparate Impact Standard\u201d to the OMB\u2019s Office of Information and Regulatory Affairs (OIRA) for review before publication, even though HUD did not provide any notice or opportunity for comment.<\/p>\n\n\n\n<p class=\"content-wrap-item post__paragraph\">The disparate impact standard has been successfully deployed to stop unlawful policies that segregate people based on their race or other protected class characteristics; dismantle redlining in insurance and lending; eliminate biased algorithms that harm people and communities; protect survivors of domestic violence; address appraisal bias that causes economic harm to affected homeowners; and halt discriminatory zoning and land-use policies. Beyond prohibiting harm, it has opened doors to greater housing security for individuals with disabilities, seniors on fixed incomes, families with children, and people of faith. It has spurred the development of affordable housing opportunities; safeguarded access to community resources such as transportation, health, and education services; and contributed to the creation of healthy communities that are free from toxins and pollution.<\/p>\n\n\n\n<p class=\"content-wrap-item post__paragraph\">\u201cThe disparate impact standard is a common-sense legal tool, and the current rule reflects decades of legal precedent,\u201d the groups wrote in the letter. \u201cWatering down HUD\u2019s current rule will undoubtedly violate the law. By comparison, the current disparate impact standard ensures fair, thriving markets.\u201d<\/p>\n\n\n\n<p class=\"content-wrap-item post__paragraph\">\u201cHUD\u2019s current disparate impact rule has worked.
